Legal Support for Property Transactions in Hurghada
Terra Egypt Realty officially cooperates on a contractual basis with an independent Egyptian law firm that provides legal support for property transactions.
The lawyers review property and seller documents, analyse contracts, prepare the necessary legal documents and coordinate registration procedures according to the circumstances of each transaction.
Terra Egypt Realty is a real estate company, not a law firm. We coordinate communication between the client, seller, developer and independent lawyer, while all legal opinions and legal services are provided directly by qualified Egyptian lawyers.
Why Legal Verification Is Important
Property transactions in Egypt may involve different types of ownership documents, contracts, land status and registration procedures.
The required legal checks depend on:
- whether the property is purchased from a developer or a private owner;
- the location and legal status of the property;
- the seller’s ownership documents;
- the status of the land and residential development;
- previous contracts and transfers;
- outstanding payments or service charges;
- the buyer’s citizenship;
- the intended method of registration or proof of ownership.
Legal verification should be completed before the buyer transfers the main payment or signs documents creating binding obligations.
Review of Property Documents
Depending on the property and transaction, the independent law firm may review:
- the seller’s purchase or ownership contract;
- the chain of previous contracts;
- the seller’s identification documents;
- powers of attorney used in previous or current transactions;
- payment confirmations;
- documents issued by the developer;
- land and construction documents where available;
- maintenance and service-charge payments;
- other documents relevant to the property.
The exact list of documents depends on the legal status of the property. The presence of one contract alone does not automatically confirm that the property is ready for a safe transaction.
Verification of the Seller
The lawyer checks the identity of the seller and the legal basis on which the seller is entitled to dispose of the property.
This may include verification of:
- the seller’s personal documents;
- the correspondence between the seller and the person named in the ownership documents;
- the authority of a legal representative;
- the validity and scope of a power of attorney;
- the seller’s right to receive payment and sign the transfer documents;
- any restrictions affecting the proposed sale.
Review and Preparation of Contracts
The independent lawyer reviews the proposed contract and explains its legal consequences to the client.
Contract work may include:
- reviewing a developer’s reservation or sale contract;
- preparing or reviewing a resale contract;
- confirming the property description and agreed price;
- checking the payment schedule;
- defining the responsibilities of the parties;
- including handover and document-transfer conditions;
- reviewing penalties, cancellation and refund provisions;
- making corrections or proposing additional clauses where necessary.
Clients should understand the contract before signing it. Verbal promises that are important to the transaction should be reflected in the written documents wherever legally appropriate.
Buying Property from a Developer
When purchasing a property in a new development, the legal review may include the developer’s company documents, the legal basis for the project, available land documents, construction information and the proposed sale contract.
The lawyer may also review:
- the unit description and project plan;
- the total price and payment schedule;
- the expected completion and handover conditions;
- maintenance and service charges;
- the developer’s cancellation and penalty clauses;
- the procedure for transferring or reselling the unit;
- the documents expected upon completion.
Construction progress, completion dates and future services may change. These matters should be clearly distinguished from the legal review of the available documents.
Buying a Resale Property
For a resale transaction, the lawyer verifies the seller’s ownership history, contracts, payments and authority to transfer the property.
The review may also include:
- confirmation that the property corresponds to the documents;
- developer or compound approval where required;
- outstanding instalments or maintenance fees;
- utility and service-related obligations;
- existing powers of attorney;
- the agreed procedure for payment and handover.
Powers of Attorney
A power of attorney may be required when a buyer or seller cannot personally attend part of the transaction.
The lawyer determines:
- whether representation by power of attorney is possible;
- which powers must be included;
- where the document must be issued;
- whether legalisation and Arabic translation are required;
- which actions the representative may perform;
- how and when the power of attorney can be cancelled.
A general or incorrectly worded power of attorney may not be sufficient for a particular property transaction. Its content must be checked before it is used.
Remote Property Transactions
Some stages of a property transaction may be coordinated while the client is outside Egypt.
Depending on the circumstances, remote support may include:
- receiving and reviewing electronic copies of documents;
- online communication with the client;
- preparing a power of attorney;
- coordinating contract corrections;
- organising signatures and payments;
- representing the client where legally authorised;
- providing updates during the transaction.
The lawyer must confirm which procedures can be completed remotely and which require the client’s personal presence or original documents.
Registration and Proof of Ownership
The appropriate registration or ownership-confirmation procedure depends on the property’s location, legal status, available documents and the structure of the transaction.
Legal work may involve:
- registration of contracts or signatures where applicable;
- preparation of documents for the competent authorities;
- legalisation and translation of documents;
- registration of a power of attorney;
- obtaining available confirmations from the developer;
- other procedures recommended by the independent lawyer.
The lawyer explains which procedure is available and appropriate for the specific property. No single registration method applies equally to every property in Egypt.
Legal Support for Property Sellers
Owners selling their property may also require legal assistance.
The independent law firm can help:
- review the seller’s available documents;
- prepare documents requested for the sale;
- verify or prepare a power of attorney;
- review the proposed sale contract;
- define the payment and handover procedure;
- coordinate signatures and transfer documents;
- complete the required legal or registration procedures.
The Role of Terra Egypt Realty
Terra Egypt Realty coordinates the practical real estate part of the transaction.
Our role may include:
- collecting available property information;
- connecting the client with the independent law firm;
- coordinating communication with the seller or developer;
- organising property viewings and inspections;
- clarifying the commercial conditions of the transaction;
- coordinating the preparation and transfer of documents;
- monitoring the agreed stages of the transaction;
- organising handover of the property and keys.
Terra Egypt Realty does not issue independent legal opinions and does not replace the lawyer responsible for the legal review.
Independent Legal Representation
The law firm cooperating with Terra Egypt Realty is an independent legal practice. Legal services are provided according to a separate agreement between the client and the law firm where required.
A client may also appoint another lawyer of their choice. If the interests of the buyer and seller conflict, the parties may require separate legal representation.
The lawyer determines the scope of the legal review, required documents, procedures, fees and professional responsibility for the legal work.
Corporate, Accounting and Tax Support
The independent professional office also provides Terra Egypt Realty with ongoing corporate legal, accounting and tax support.
This includes coordination of the company’s legal documentation, accounting obligations, tax reporting and other corporate procedures required for its official business activities in Egypt.
This professional cooperation allows Terra Egypt Realty to maintain clear internal procedures and coordinate client transactions with appropriate legal oversight.
How Legal Support Is Organised
- The client selects a property or agrees the proposed transaction.
- Available documents are collected for preliminary review.
- The independent lawyer determines the required legal checks.
- The documents, seller and proposed contract are reviewed.
- Any risks, missing documents or required corrections are explained.
- The contract and transaction procedure are prepared or amended.
- The parties sign the documents and complete the agreed payments.
- The lawyer completes the applicable registration or legal procedures.
Legal Fees and Additional Costs
Legal fees are calculated separately by the independent law firm and depend on the property, document status, transaction value and amount of legal work required.
Translation, legalisation, powers of attorney, government fees, registration charges and other external expenses may be payable separately.
The scope and expected cost of the legal work should be agreed before the lawyer begins the relevant procedures.
Important Information
The information on this page is general and does not constitute individual legal advice. Egyptian legislation, administrative procedures and document requirements may change.
Final decisions should be made only after the independent lawyer has reviewed the documents and circumstances of the specific property transaction.
