Buying Property in Egypt: A Guide for Foreign Buyers

Buying property in Egypt can be straightforward, but the safety of the transaction depends on proper document checks, a clear contract and a transparent payment process. A beautiful sea view is important — but it does not replace legal due diligence.

Can foreigners buy property in Egypt?

Foreign nationals can purchase apartments, houses and villas in Egypt. The applicable procedure may depend on the buyer’s nationality, the location and legal status of the property, the type of development and the form of ownership.

Before paying a deposit, the property and the seller’s authority to complete the transaction should be checked by a qualified Egyptian lawyer.

What should be checked before buying?

For every property, the legal review should normally include:

  • the identity and authority of the seller;
  • the ownership history and available title documents;
  • the legal status of the land and building;
  • building permits and approvals, where applicable;
  • outstanding maintenance, utility or service charges;
  • restrictions affecting resale or registration;
  • the payment schedule, delivery terms and penalties stated in the contract.

The exact list depends on whether the property is purchased from a developer or on the resale market.

Buying from a developer

When purchasing a property in a new development or off-plan project, buyers should check the developer’s legal status, rights to the land, project documentation, construction schedule and contractual obligations.

The contract should clearly state:

  • the unit number, floor, area and specifications;
  • the total price and payment plan;
  • the expected delivery date;
  • finishing and furnishing conditions;
  • maintenance and service fees;
  • penalties for late payment or delayed delivery;
  • conditions for resale, assignment and registration.

Marketing materials and verbal promises should not replace written contractual terms.

Buying a resale property

For resale property, it is important to confirm that the seller has the legal right to sell and that the chain of previous contracts is complete.

The review may also include utility bills, maintenance payments, powers of attorney, possession documents and any obligations connected with the property.

Money should not be transferred solely on the basis of copies sent through WhatsApp. Originals or properly authenticated documents must be reviewed.

Deposit, contract and payments

Before paying a reservation fee or deposit, the buyer should understand:

  • whether the payment is refundable;
  • what happens if the legal review reveals a problem;
  • which currency and payment method will be used;
  • who receives the money;
  • when ownership or possession is transferred.

All payments should be documented with contracts, receipts or bank records. The final contract must accurately identify the property, buyer, seller, price and payment conditions.

What is a Green Contract?

“Green Contract” is the commonly used name for full state registration of real estate ownership in Egypt.

Not every property on the Red Sea is registered in the same way or immediately eligible for the same registration procedure. The available legal route depends on the land, project and ownership documents.

Signature validation confirms that a person signed a contract, but it is not automatically the same as full state registration of ownership. A lawyer should explain which registration procedure applies to the specific property.

Can property be purchased remotely?

In many cases, a transaction can be completed remotely through a properly prepared power of attorney and verified documentation.

The buyer should understand exactly which powers are granted, how long the power of attorney remains valid and whether it permits signing, payment, registration or resale.

Does buying property provide residency?

Property ownership does not automatically guarantee Egyptian residency or citizenship. Depending on the value and legal status of the property, ownership may support an application for residency under the rules in force at that time.

Current requirements should always be confirmed before relying on residency as part of the purchase decision.

Additional purchase costs

In addition to the property price, buyers may need to budget for:

  • legal review and contract preparation;
  • registration and administrative procedures;
  • agency commission;
  • maintenance or service charges;
  • utility meters and connection fees;
  • furnishing, renovation or property management.

Request a written breakdown of all known costs before signing the contract.
